1. Program Description

Home Protection Gutters LLC (“we,” “us,” “our”) operates an SMS messaging program that sends text messages to homeowners regarding gutter protection, gutter guard installation, gutter cleaning, and related home services. When you opt in, you will receive messages about:

  • Gutter protection and gutter guard service offers
  • Free inspection offers
  • Appointment confirmations and reminders
  • Follow-ups on prior conversations or inquiries
  • Customer service replies to questions you send via text

Messages are sent to recipients who have affirmatively consented to receive them, as described in Section 2 below.

This SMS program is operated on a mixed-use basis, combining marketing communications with customer care messaging (appointment confirmations, service follow-ups, and reply-based customer support).

2. Consent (Opt-In)

We only send SMS messages to individuals who have affirmatively opted in — whether by checking our website consent checkbox or by providing their number directly to us during a service inquiry. The checkbox is never pre-checked, and consent is not a condition of purchasing any goods or services. We do not purchase or use third-party SMS marketing lists. Your consent is not shared, sold, or transferred to any third party for their own marketing purposes.

By opting in, you also consent to the use of an automated telephone dialing system (ATDS) to send messages to the number you provided, as described in Section 8.

3. Message Frequency

Message frequency varies. You will not receive messages on a fixed daily or weekly schedule. The number of messages you receive depends on your level of engagement. Typical messaging patterns include:

  • Initial outreach or campaign messages (e.g., a free inspection offer)
  • Follow-up messages if you reply or show interest
  • Appointment confirmation and reminder messages
  • Customer service replies

There is no minimum or maximum number of messages you will receive in a given period. If at any time you wish to stop receiving messages, follow the opt-out instructions in Section 5.

4. Message and Data Rates

Standard message and data rates may apply to the SMS messages we send to you and to any messages you send to us. Charges will appear on your wireless bill or be deducted from your prepaid balance. Contact your wireless carrier for pricing details. Home Protection Gutters does not charge you for receiving SMS messages, and we are not responsible for any message or data charges imposed by your carrier.

5. Opt-Out Instructions (Reply STOP)

You may opt out of receiving SMS messages from Home Protection Gutters at any time by replying STOP to any message you receive.

Opt-out confirmation: After you reply STOP, we will send you a single confirmation message acknowledging that you have been unsubscribed. This confirmation is the only message you will receive after opting out, and no further messages will be sent to you unless you re-subscribe by affirmatively opting in again at a later date.

Please allow up to 24 hours for the opt-out to take full effect across all systems.

Carriers are not liable for delayed or undelivered messages. Message delivery is subject to your carrier’s network availability and your device’s ability to receive messages. We make no warranty as to the deliverability or timeliness of any SMS message.

8. Automated Technology Disclosure

Messages may be sent using an automatic telephone dialing system (ATDS) or other automated technology. This means that some messages you receive may be generated and delivered through automated systems rather than manually composed by a human representative. This disclosure is made in compliance with the federal Telephone Consumer Protection Act (TCPA) and applicable state laws.

By providing your consent, you acknowledge and agree that automated technology may be used to send text messages to the number you provided.

9. Privacy Policy

Your privacy is important to us. Our collection, use, and disclosure of your personal information — including your phone number — is governed by our Privacy Policy, which is available at:

10. Data Sharing and Third Parties

Home Protection Gutters does not sell, rent, or share your phone number or SMS consent status with third parties for their own marketing purposes. We may share your information with:

  • Our SMS service provider (Telnyx): Telnyx processes and delivers SMS messages on our behalf. Telnyx is contractually prohibited from using your information for any purpose other than delivering messages for us.
  • Other service providers: We may engage third-party vendors to support our business operations (e.g., appointment scheduling, analytics), and these vendors may have incidental access to contact information as needed to perform their services. All such vendors are bound by confidentiality and data protection obligations.

11. Age Restriction

You must be 18 years of age or older to consent to receive SMS messages from Home Protection Gutters. By opting in, you represent and warrant that you are at least 18 years old. We do not knowingly send SMS messages to, or collect personal information from, individuals under the age of 18.

12. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Home Protection Gutters LLC, its affiliates, employees, agents, and service providers from any claims, damages, or losses arising out of:

  • Your provision of a false or inaccurate phone number
  • Your provision of a phone number belonging to a third party without that party’s consent
  • Your violation of any applicable law or regulation in connection with your use of the SMS program

13. Changes to These Terms

We reserve the right to update or modify these SMS Terms and Conditions at any time, in our sole discretion. When we make changes, we will update the “Last Updated” date at the top of this document.

Material changes will be communicated via an updated posting on our website and, where appropriate, through a notice sent via SMS or other means.

Your continued participation in the SMS program after changes take effect constitutes your acceptance of the updated terms. If you do not agree to the updated terms, you may opt out at any time by replying STOP.

14. Term and Termination

These SMS Terms and Conditions remain in effect until terminated by either party. You may terminate your participation in the SMS program at any time by opting out (reply STOP). We reserve the right to terminate or suspend the SMS program, or your participation in it, at any time without notice, for any reason, including if we determine that you have violated these terms or applicable law.

Upon termination, you will receive no further SMS messages from us (other than a single opt-out confirmation if you initiated the termination), and Section 9 (Privacy Policy) will continue to govern our use of your information.

15. Limitation of Liability

To the fullest extent permitted by law, Home Protection Gutters LLC, its affiliates, and its service providers (including Telnyx) shall not be liable for:

  • Any delayed, undelivered, misdirected, or garbled SMS messages
  • Any errors or omissions in message content
  • Any damages arising from your participation in the SMS program
  • Any acts or omissions of wireless carriers or third-party service providers

Neither Home Protection Gutters nor its wireless carriers are responsible for any undelivered or delayed messages due to network outages, device limitations, or other factors beyond our reasonable control.

16. Governing Law

These SMS Terms and Conditions are governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict of laws principles. Any disputes arising out of or relating to these terms or the SMS program shall be resolved exclusively in the state or federal courts located in Jackson County, Missouri.
